⚠️ IMPORTANT - PLEASE READ CAREFULLY

By booking vehicle transport services with Premier Freight & Auto Brokers, LLC, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions. These terms constitute a legally binding agreement between you (the "Customer" or "Shipper") and Premier Freight & Auto Brokers, LLC (the "Broker" or "Company").

1.BROKER STATUS AND SERVICES

1.1 Broker Capacity

Premier Freight & Auto Brokers, LLC operates as a licensed transportation broker and is NOT a motor carrier. We arrange for the transportation of vehicles by contracting with licensed and insured third-party motor carriers. We do not own or operate transport trucks.

1.2 Services Provided

  • Arranging vehicle transportation with qualified carriers
  • Obtaining competitive quotes for transport services
  • Coordinating pickup and delivery schedules
  • Acting as liaison between customer and carrier
  • Providing customer support throughout the transport process

1.3 Services NOT Provided

The Broker does not:

  • Physically transport vehicles
  • Guarantee specific pickup or delivery dates (estimates only)
  • Provide insurance coverage (carrier provides insurance)
  • Accept responsibility for carrier delays or performance

2.BOOKING AND PAYMENT TERMS

2.1 Deposit Requirements

A non-refundable deposit is required at the time of booking to secure transportation services. The standard deposit amount is communicated during the quote process. This deposit confirms your reservation and initiates carrier assignment.

2.2 Balance Payment

The remaining balance is due to the carrier upon delivery of the vehicle. Payment must be made in:

  • Cash
  • Cashier's Check
  • Money Order
  • Or other payment method agreed upon with the carrier

Important: The carrier will NOT release your vehicle until payment is received in full.

2.3 Price Changes

The quoted price is valid for 7 days from the date of the quote. Prices may change based on:

  • Fuel price fluctuations
  • Seasonal demand changes
  • Route availability
  • Changes to pickup or delivery locations
  • Vehicle condition or size discrepancies

2.4 Additional Fees

Additional charges may apply for:

  • Oversized or inoperable vehicles
  • Remote or difficult-to-access locations
  • Expedited service requests
  • Enclosed transport upgrades
  • Changes to agreed pickup/delivery locations after carrier assignment

3.CANCELLATION AND REFUND POLICY

3.1 Deposit Non-Refundable

ALL DEPOSITS ARE NON-REFUNDABLE. By placing a deposit, you acknowledge that this fee covers:

  • Administrative costs
  • Carrier search and coordination
  • Reservation of carrier capacity
  • Processing and documentation

3.2 Customer Cancellation

If you cancel your order after a carrier has been assigned, you may be subject to additional cancellation fees charged by the carrier. These fees can range from $50 to the full remaining balance depending on timing and carrier policy.

3.3 Carrier Cancellation

In the rare event a carrier cancels after assignment, we will:

  • Immediately assign a new carrier at no additional cost
  • Apply your deposit to the new carrier assignment
  • Maintain your original quoted price

4.PICKUP AND DELIVERY

4.1 Date Estimates

ALL PICKUP AND DELIVERY DATES ARE ESTIMATES ONLY and are not guaranteed. Actual dates may vary due to:

  • Weather conditions
  • Traffic delays
  • Mechanical issues
  • Carrier schedule changes
  • Other unforeseen circumstances

We cannot be held liable for delays or changes to estimated dates.

4.2 Pickup Windows

Standard pickup windows are typically 1-5 business days from the first available date. Expedited service may be available for an additional fee.

4.3 Delivery Windows

Delivery times depend on distance:

  • 0-500 miles: 1-2 days
  • 500-1500 miles: 2-5 days
  • 1500+ miles: 5-7 days
  • Cross-country: 7-10 days

These are estimates and may vary.

4.4 Customer Availability

You or your authorized representative must be available at both pickup and delivery locations. If you are not available when the carrier arrives, additional fees may apply for return trips.

5.VEHICLE PREPARATION AND CONDITION

🚗 CRITICAL: VEHICLE PREPARATION REQUIREMENTS

Failure to properly prepare your vehicle may result in additional charges, delays, or refusal of transport.

5.1 Required Preparations

Before pickup, you MUST:

  • Remove ALL personal items from the vehicle (see Section 6)
  • Leave fuel level at 1/4 tank or less
  • Ensure vehicle is clean for proper inspection
  • Disable car alarm
  • Provide all necessary keys (including spare if available)
  • Document existing damage with photos
  • Remove or secure loose parts (spoilers, antennas, etc.)
  • Ensure vehicle is accessible and ready for loading

5.2 Inoperable Vehicles

If your vehicle is inoperable (does not start, brake, steer, or roll), you MUST disclose this at the time of booking. Inoperable vehicles require special equipment and incur additional fees. Failure to disclose may result in:

  • Refusal of transport by the carrier
  • Additional charges ($150-$300)
  • Delays in assignment of a new carrier

5.3 Vehicle Inspection

A thorough inspection (Bill of Lading) will be conducted at both pickup and delivery. You or your representative must:

  • Be present for inspection
  • Note any pre-existing damage
  • Sign the Bill of Lading
  • Keep a copy for your records

5.4 Modifications and Oversized Vehicles

Vehicles with modifications (lift kits, lowered suspension, oversized tires) or that exceed standard dimensions must be disclosed. Additional fees may apply.

6.PERSONAL PROPERTY

❌ ABSOLUTE PROHIBITION ON PERSONAL ITEMS

NO PERSONAL ITEMS ARE PERMITTED IN THE VEHICLE DURING TRANSPORT

6.1 Personal Items Policy

Federal DOT regulations and carrier insurance policies PROHIBIT the transport of personal belongings in vehicles. This includes but is not limited to:

  • Clothing, bags, or luggage
  • Electronics or valuables
  • Tools or equipment
  • Documents or paperwork
  • Household items
  • Any item not permanently affixed to the vehicle

6.2 Liability for Personal Items

Neither the Broker nor the Carrier assumes any liability for personal items left in the vehicle. If personal items are found in the vehicle:

  • They are NOT covered by carrier insurance
  • The carrier may refuse to transport the vehicle
  • You may be charged additional fees
  • Items may be removed and discarded
  • No claims will be accepted for missing or damaged personal items

6.3 Exceptions

The ONLY items permitted are:

  • Factory-installed equipment
  • Spare tire and jack (if factory-provided)
  • Floor mats

7.INSURANCE AND CLAIMS

7.1 Carrier Insurance

All carriers contracted by Premier Freight & Auto Brokers are licensed, bonded, and insured. The carrier's insurance covers vehicle damage during transport, subject to the carrier's insurance policy terms and conditions.

7.2 Insurance Coverage

Typical carrier insurance provides coverage for:

  • Damage occurring during loading/unloading
  • Damage during transport
  • Collision or accident damage

NOT covered:

  • Pre-existing damage
  • Personal items (see Section 6)
  • Mechanical failures unrelated to transport
  • Damage from acts of God (severe weather, natural disasters)
  • Damage not noted on delivery inspection

7.3 Filing a Claim

If damage occurs during transport:

  1. Document immediately: Note ALL damage on the Bill of Lading at delivery
  2. Take photos: Photograph all damage before signing
  3. Do not refuse delivery: Refusing delivery complicates claims
  4. Sign with notation: Write "Subject to inspection" or note specific damage
  5. Contact us immediately: Report damage within 24 hours
  6. File formal claim: Complete claim paperwork within carrier's timeframe

7.4 Broker's Role in Claims

As a broker, we will:

  • Assist you in filing claims with the carrier
  • Provide carrier insurance information
  • Facilitate communication between you and the carrier

We cannot:

  • Process or pay claims directly
  • Guarantee claim approval or amounts
  • Override carrier insurance decisions

7.5 Claim Limitations

Claims must be filed within the timeframe specified by the carrier (typically 30-90 days). Claims not properly documented or filed within required timeframes may be denied.

8.CUSTOMER RESPONSIBILITIES

8.1 Accurate Information

You are responsible for providing accurate information about:

  • Vehicle year, make, model, and condition
  • Pickup and delivery addresses
  • Contact phone numbers
  • Vehicle modifications or special requirements
  • Accessibility of pickup/delivery locations

8.2 Communication

You agree to:

  • Respond promptly to carrier and broker communications
  • Be available by phone during estimated pickup/delivery windows
  • Notify us immediately of any changes to contact information or locations

8.3 Location Accessibility

You must ensure that pickup and delivery locations are:

  • Accessible to large transport trucks (53-80 feet long)
  • Free from low-hanging obstacles (trees, power lines, etc.)
  • On paved or hard-packed surfaces
  • Legally accessible (carrier is not liable for parking violations)

If the carrier cannot access the location safely, you may need to meet at an alternative location.

9.LIMITATION OF LIABILITY

9.1 Broker Liability

Premier Freight & Auto Brokers, LLC liability is strictly limited to brokerage services only. We are NOT liable for:

  • Damage to vehicles during transport
  • Delays or failure to deliver
  • Carrier negligence or misconduct
  • Loss or damage to personal property
  • Mechanical failures
  • Acts of God or circumstances beyond our control

9.2 Maximum Liability

In no event shall the Broker's total liability exceed the amount of the deposit paid by the customer.

9.3 Consequential Damages

The Broker is not liable for any indirect, consequential, or incidental damages including but not limited to:

  • Lost wages or income
  • Travel expenses
  • Rental car costs
  • Storage fees
  • Emotional distress

10.DISPUTE RESOLUTION

10.1 Arbitration Agreement

Any dispute, claim, or controversy arising out of or relating to these Terms and Conditions or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration.

10.2 Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of the State in which Premier Freight & Auto Brokers, LLC is registered, without regard to its conflict of law provisions.

10.3 Waiver of Class Action

You agree to bring claims against the Broker only in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.

11.GENERAL PROVISIONS

11.1 Entire Agreement

These Terms and Conditions, along with your booking confirmation, constitute the entire agreement between you and Premier Freight & Auto Brokers, LLC.

11.2 Modifications

We reserve the right to modify these Terms and Conditions at any time. Changes will be effective immediately upon posting to our website. Your continued use of our services constitutes acceptance of any changes.

11.3 Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect.

11.4 Force Majeure

Neither party shall be liable for any failure or delay in performance due to circumstances beyond their reasonable control, including but not limited to acts of God, war, terrorism, riots, embargoes, acts of civil or military authorities, fire, floods, accidents, strikes, or fuel shortages.
